1. Who we are
The Pretty Problem ("we", "us", "our") is operated by Flipping Innovations. By accessing or using our website, app, or services (the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
2. Eligibility
You must be of legal age in your jurisdiction (or have parent/guardian consent) to use the Service. If you use the Service on behalf of an organization, you represent you have authority to bind that organization.
3. The Service
The Service provides a 21-day athletic training challenge including workouts, drills, mindset prompts, journaling, progress tracking, and related content. Content is provided for general fitness and educational purposes only and is not medical advice. Consult a qualified professional before starting any exercise program.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and keep it updated.
5. Acceptable use
You must not misuse the Service. Prohibited activities include, without limitation: unlawful use; fraud or spam; infringing intellectual property rights; uploading malware; probing, scanning, or otherwise interfering with the security or integrity of the Service; and scraping or bulk-extracting content.
6. Intellectual property
All content in the Service — including workouts, videos, imagery, text, software, and branding — is owned by Flipping Innovations or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes under your active plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits.
7. Payments, billing, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our money-back guarantee.
8. Service level
We aim to keep the Service available and functional but do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is capped at the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.
10. Indemnification
You agree to indemnify Flipping Innovations against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
11. Suspension and termination
We may suspend or terminate your access for material breach, non-payment, suspected fraud or security risk, or repeated policy violations. On termination, your right to use the Service ends. You may export or request deletion of your data as described in our Privacy Notice.
12. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Flipping Innovations is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction.
